Inspection: Within seven days of receipt of the Products, Buyer shall inspect the Products to check for shortages, loss or damage in transit and any other non-conformity. The failure to provide Seller with written notice within this time period shall constitute an unqualified acceptance of the Products and a waiver by Buyer of all claims for shortages, incorrect material and other non-conformities, including a waiver of any right of revocation of acceptance.
Limited Warranty: AbSolo Fitness Machines are warranted to be free of defects in material and workmanship occuring in normal usage within one (1) year from date of purchase. The following parts thereof ("Parts"), the Sleeve Part is warranted to be free of defects in material and workmanship occuring in normal usage within one (1) year from date of purchase; The Front Vinyl Ball Stopper Part is warranted to be free of defects in material and workmanship occuring in normal usage within one (1) year from date of purchase; and the Seat Springs Part is warranted to be free of defects in material and workmanship occurring in normal usage within one (1) year from date of purchase invoice. AbSolo Fitness ("Absolo Management, LLC") will, at it's election, repair, replace or make appropriate adjustment with respect to the AbSolo Fitness Machines and Parts thereof where AbSolo Management's inspection discloses the aforesaid defect occurring in normal usage with the warranty time periods set forth above. Exclusivity of Remedy: Limitation of Liability: In the event Buyer claims that Seller or WomensPersonalFitness.net has breached any of it's obligations under this PO, Seller's sole responsibility and Buyer's exlusive remedy is, at Seller's option, either: (i) repair or replacement of the Products, or (ii) the refund by Seller to Buyer of the purchase price of the Products, less any shipping and handling charges. Seller, in it's sole discreation, may choose refund, repair or replacement. The remedies provided in this section shall constitute the sole recourse of Buyer against Seller & WomensPersonalFitness.net for breach of any of seller's obligations under this PO with Buyer including claims based on warranty, negligence or otherwise. In no event will Seller or WomensPersonalFitness.net be liable for any lost revenues, lost profits, incidental, indirect consequential, special or punitive damages.
